In addition to the penalty provisions set forth in G.S. § 143-215.58, any person violating the provisions of this chapter shall be subject to a civil penalty in the amount of $100 per violation. Each day such violation continues shall be considered a separate offense. The person cited for the violation must pay the civil penalty within five days of being cited for the violation. In the event that the person cited for the violation does not pay the civil penalty within the prescribed time, the town may bring a civil action to recover the penalty and associated court costs. Nothing herein contained shall prevent the Town of Duck from taking such other lawful action as is necessary to prevent or remedy any violation.
