§ 93.07 STRAY ANIMALS.
   (A)   No person owning, or having charge, care, or control of, any animal shall cause, permit, or allow such animal to run at large off of the property, or premises, of the owner, or of the person having charge, care, or control of such animal, and any such animal running at large is hereby declared to be a public nuisance.
   (B)   Any stray animal, or animal running at large, may be taken under control by any law enforcement officer and, at the officer’s discretion, either returned to the owner, or impounded at a location approved by the county for temporary maintenance of stray animals for a period of not less than three days, after which three-day period said animal, if not claimed by its owner, may be sold or destroyed. If said animal is claimed by its owner, all costs of maintaining said animal, including reasonable boarding fee, shall, in addition to any penalty hereinafter set forth, be paid by said owner prior to the release of said animal, provided, however, that nothing herein shall prevent any law enforcement officer from immediately destroying any vicious, uncontrollable, or diseased animal.
