(A) No person in charge of a locomotive shall fail to bring the locomotive to a full stop at least 200 feet before arriving at a crossing with another track, or proceed through the crossing before signaled to do so or before the way is clear.
(B) (1) Whoever violates this section or fails to comply with R.C. § 4955.32(B)(1) is guilty of a misdemeanor of the fourth degree. If the violation or failure to comply causes physical harm to any person, whoever violates this section or fails to comply with R.C. § 4955.32(B)(1) is guilty of a misdemeanor of the third degree.
(2) With respect to a charge of violating division (B)(1) of this section for a failure to comply with R.C. § 4955.32(B)(1), it is an affirmative defense that an alternative audible warning system described in division (B)(2) of that section was activated. (R.C. § 4999.04)
