1325.07 APPEAL ON REFUSAL TO ISSUE PERMIT.
   (a)   Except as provided in subsection (b), below, a refusal by the Director of Public Service to issue a permit, as provided in Section 1325.05, may be appealed in writing within ten days after such refusal to the Planning Commission, as provided for in other cases of appeals thereto. The Commission shall then, in accordance with its rules of procedure, investigate such application and refusal, and render final judgment based upon whether, in its opinion, the provisions of this chapter have been and will be complied with.
   (b)   In the event that the Director of Public Service refuses to issue such permit due in whole or in part to a violation of the lot area restrictions established in Chapter 1151, then the applicant shall appeal said decision as it relates to Chapter 1151 to the Board of Zoning Appeals pursuant to the process established by Chapter 1127. Said appeal shall be in addition to the appeal referenced in subsection (a), above, as it relates to any other reasons for refusal.
