935.02 AVAILABILITY.
(a) Internet services shall be available system wide to all commercial consumers located within or outside the corporation limits of the City of Dover who are purchasing electric services from the Dover Electric Distribution system and have access to the City of Dover telecommunications network. The City Director of Telecommunications shall have discretion in determining whether a particular consumer has access to the telecommunications system, with due consideration of the infrastructural components thereof.
(b) The City Director of Telecommunications shall develop rules and regulations governing the process by which application for internet service may be made. Said regulations shall be placed on file with the Clerk of Council, and shall be available for public inspection in the office of the City Director of Telecommunications.
(d) Subject to the rates established pursuant to Section 935.03, the City Director of Telecommunications shall be empowered to negotiate end user agreements and contract terms pertaining to issues such as server colocation, web, hosting, customer firewall and network requirements, static IP addressing, contract conditions, customer hardware requirements, and other services to be provided. The City Director of Telecommunications may establish regulations containing minimum specifications for hardware and equipment for end users.
