923.14 CITY CONSTRUCTION OF WATER LINES; CHARGES.
(a) If the owner or owners of lots or lands petition the City to construct a water line for his or their use in accordance with the City engineering specifications, the fees in Sections 923.10 and 923.11 shall be paid to the City or the sum of fifteen dollars ($15.00) per foot frontage for each side of the street or thirty dollars ($30.00) per foot frontage for both sides of the street shall be paid to the City the higher cost of the aforementioned fees will be the applicable fee. Where the water line construction costs exceed the fees to be paid by the front footage method or Section 923.10 schedule times the applicable lots, lands or buildings, the costs not recovered or having the possibility of not being recovered shall be equally divided between the City and those land owners who would benefit from the construction of the water line.
(b) The above shall be modified for the following situation: Whenever the requested water line construction serves lots or lands only on one side of a street, the applicable front footage fee for that situation shall be thirty dollars ($30.00) per foot frontage.
(c) The fifteen dollar ($15.00) and thirty dollar ($30.00) front footage costs are estimates of all the costs to install a Water Main including manholes, fittings, pavement or right of way repair, engineering, inspection, legal fees or any other cost directly related to such installation. These costs shall be used for making the original determination of individual and City construction costs. After the water main has been installed, a final cost determination shall be made based upon the actual installation costs. Individual construction charges and the portion to be paid by the City will then be adjusted either upward or downward according to the final costs.
(d) Upon request of the landowner pursuant to this section, the Director of Public Service shall determine the estimated cost pursuant to this section and shall in writing notify the landowner of the landowner’s estimated portion of the construction cost. Within fifteen days after such notification, the landowner shall deposit with the City a sum equal to the estimated cost. Such sum shall be deposited in the appropriate construction fund and the landowner shall be credited with the receipt thereof. Upon completion, the landowner’s portion of the cost shall be paid from the fund. If the actual cost of construction is less than the estimated cost the Service Director shall cause the balance of the deposit to be returned to the landowner. If the actual cost is greater than the estimated cost then the landowner shall remit the entire balance due before he shall be permitted to connect to the system.
