5-25-2: LICENSE REQUIRED:
   (A)   It is unlawful to transfer, distribute, process, sell or offer for sale in the city any cannabis (i) without a license issued by the city pursuant to this chapter, or (ii) otherwise in violation of the terms of such license or the provisions of this chapter or the Act.
   (B)   An application for a license for the transfer, distribution, process or sale of cannabis within the city shall be made to the city clerk in writing, on the form or forms as prepared by the city, and shall be signed by the applicant or a duly authorized agent thereof. The application shall be accompanied by the applicable license fee as provided in section 5-25-3 and contain the following minimum information:
      1.   The name, age and address of the applicant. In the case of a partnership, corporation, limited liability company or other business, the date of its formation, the objects for which it was formed, and the names and addresses of its officers, directors, members, partners or other persons authorized to act for and on behalf of the business. A certified copy of the organizational documents filed with the Illinois Secretary of State and a current Certificate of Good Standing or Certificate of Existence shall be provided.
      2.   The location and description of the premises or place of business to be operated under such license. If the applicant is not the owner of the premises, a copy of the written, signed lease or other written authority for use of the premises shall be provided.
      3.   A statement whether the applicant has made any applications for a similar license other than described in the application, and the disposition of such application.
      4.   A statement that the applicant has never been convicted of a felony and is not disqualified to receive a license by reason of any matter or thing contained in this chapter, the laws of the state or the ordinances of the city.
      5.   Whether a previous license by any state, or subdivision thereof, or by the federal government has been revoked, and the reasons therefor.
      6.   A statement that the applicant will not violate any state or federal law or city ordinance in the conduct of the place of business.
   (C)   No license shall be issued unless the applicant has applied for and received a license from the state for the transfer, distribution, process or sale of cannabis as provided in the Act.
   (D)   No license shall be issued or renewed unless the premises on which the transfer, distribution, process or sale of cannabis is proposed to occur complies in all respects with the applicable zoning ordinances and building and fire codes for the city. Prior to issuance or renewal, the city building official and the fire chief shall inspect the premises for compliance. (Ord. 3177, 12-2-2019)
