10-1-1: DEFINITIONS:
Whenever in this title the following terms are used, they shall have the meanings respectively ascribed to them in this chapter:
ALLEY:
A public way within a block generally giving access to the rear of lots or buildings, and not used for general traffic circulation.
ALL-TERRAIN VEHICLE:
Any motorized off-highway device designed to travel primarily off-highway, fifty (50) inches or less in width, having a manufacturer's dry weight of one thousand five hundred (1,500) pounds or less, traveling on three (3) or more non-highway tires, designed with a seat or saddle for operator use, and handlebars or steering wheel for steering control, except equipment such as lawnmowers.
AUTOCYCLE:
A three (3)-wheel motor vehicle that has a steering wheel and seating that does not require the operator to straddle or sit astride it.
BICYCLES:
Every device propelled by human power upon which any person may ride, having two (2) tandem wheels except scooters and similar devices.
CROSSWALK:
That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the street measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway, and in the absence of a sidewalk on one side of the street, that part of the street included within the extension of the lateral line of the existing sidewalk to the side of the street without the sidewalk, with such extension forming a right angle to the centerline of the street, and any portion of a street at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface placed in accordance with the provisions in the manual adopted by the Illinois Department of Transportation as authorized in Section 11-301 of the Illinois Vehicle Code.
DRIVER:
Every person who drives or is in actual physical control of a vehicle.
EMERGENCY VEHICLE:
Police vehicles, vehicles of the fire department, ambulances, vehicles carrying a state, county or municipal officer or employee in response to an emergency call, and emergency vehicles of public service corporations on an emergency call.
EXPLOSIVE:
Any chemical compound or mechanical mixture that is commonly used or intended for the purpose of producing an explosion and which contains any oxidizing and combustive units or other ingredients in such proportions, quantities, or packing that an ignition by fire, by friction, by concussion, by percussion, or by a detonator of any part of the compound or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous pressures are capable of producing destructible effects on contiguous objects or of destroying life or limb.
FARM TRACTOR:
Every motor vehicle designed and used primarily as a farm implement for drawing wagons, plows, mowing machines, and other implements of husbandry, and every implement of husbandry which is self propelled, excluding all-terrain vehicles and off-highway motorcycles.
FLAMMABLE LIQUIDS:
Any liquid which has a flashpoint of seventy degrees Fahrenheit (70°F) or less, as determined by Tagliabue or equivalent closed cup test device.
HOLIDAY:
Shall include the following days only: New Years Day, Good Friday, Memorial Day, Fourth Of July, Labor Day, Thanksgiving and Christmas Day and any and all other holidays which may be established as holidays by the Illinois legislature in the future.
IMPROVED HIGHWAY:
A roadway of concrete, brick, asphalt, macadam and crushed stone or gravel.
IN-LINE SPEED SKATES:
A manufactured or assembled device consisting of an upper portion that is intended to be secured to a human foot, with a frame or chassis attached along the length of the bottom of the upper portion, with the frame or chassis holding two (2) or more wheels that are longitudinally aligned and used to skate or glide by means of human foot and leg power while having the device attached to each foot or leg. The upper portion may not extend more than two (2) inches above the wearer's ankle joint.
INTERSECTION:
The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two streets which join one another at, or approximately at, right angles or the area within which vehicles traveling upon different roadways joining at any other angle may come in conflict. Where a highway includes two (2) roadways forty feet (40') or more apart, then every crossing of each roadway of such divided street by an intersecting street shall be regarded as a separate intersection. The junction of an alley with a street or highway does not constitute an intersection.
LANED ROADWAY:
A street, the roadway of which is divided into two (2) or more clearly marked lines for vehicular traffic.
LOADING ZONE:
The space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.
LOW-SPEED ELECTRIC BICYCLE:
A bicycle equipped with fully operable pedals and an electric motor of less than seven hundred fifty (750) watts that meets the requirements of one of the following classes: (i) "Class 1 low-speed electric bicycle" means a low-speed electric bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the bicycle reaches a speed of twenty (20) miles per hour; (ii) "Class 2 low-speed electric bicycle" means a low-speed electric bicycle equipped with a motor that may be used exclusively to propel the bicycle and that is not capable of providing assistance when the bicycle reaches a speed of twenty (20) miles per hour; (ii) "Class 3 low-speed electric bicycle" means a low-speed electric bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the bicycle reaches a speed of twenty eight (28) miles per hour. A low-speed electric bicycle is not a moped or a motor driven cycle.
LOW-SPEED GAS BICYCLE:
A two (2) or three (3)-wheeled device with fully operable pedals and a gasoline motor of less than one horsepower, whose maximum speed on a paved level surface, when powered solely by such a motor while ridden by an operator who weighs one hundred seventy (170) pounds, is less than twenty (20) miles per hour.
MERGING TRAFFIC:
A maneuver executed by the drivers of vehicles on converging roadways to permit simultaneous or alternate entry into the junction thereof, wherein the driver of each vehicle involved is required to adjust his vehicular speed and lateral position so as to avoid a collision with any other vehicle.
METAL TIRES:
Every tire the surface of which in contact with the roadway is wholly or partially of metal or other hard, nonresilient material.
MOTOR VEHICLE:
Every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails, except for vehicles moved solely by human power, motorized wheelchairs, low-speed electric bicycles, and low-speed gas bicycles.
MOTORCYCLE:
Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three (3) wheels in contact with the ground, but excluding an autocycle or tractor.
MOTORIZED WHEELCHAIR:
Any self-propelled vehicle, including a three-wheeled vehicle, designed for and used by a person with disabilities, that is incapable of a speed in excess of eight (8) miles per hour on level ground.
OFF-HIGHWAY MOTORCYCLE:
Any motorized device designed to travel primarily off-highway on two (2) wheels, having a seat or saddle for the use of the operator, upon or by which any person, persons or property may be transported or drawn.
PARK:
To stand a vehicle, whether occupied or not, otherwise than when temporarily and actually engaged in loading or unloading merchandise or passengers.
PARKING METER:
A mechanical device located upon a public street or sidewalk in a place designated by the council as a "parking meter zone" hereafter defined, which device shall record a certain number of minutes by the use of a clock determining the period of time for which parking privileges may be extended to the person depositing a coin therein.
PARKING METER ZONE:
An area designated by the council where a vehicle may be temporarily parked and allowed to remain for the period of time indicated on the meter.
PEDESTRIAN:
Any person afoot or wearing in-line speed skates, including a person with a physical, hearing, or visual disability.
PNEUMATIC TIRE:
Every tire in which compressed air is designed to support the load.
POLE TRAILER:
Every vehicle without motive power designed to be drawn by another vehicle and attached to the towing vehicle by means of a reach or pole, or by being boomed or otherwise secured to the towing vehicle, and ordinarily used for transporting long or irregularly shaped loads such as poles, pipes or structural members capable, generally, of sustaining themselves as beams between the supporting connections.
PROPERTY LINE:
The line marking the boundary between any street and the lots or property abutting thereon.
PUBLIC BUILDING:
A building used by the municipality, the county, any park district, school district, the state, or the United States government.
RIGHT OF WAY:
The right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other.
ROAD TRACTOR:
Every motor vehicle designed and used for drawing other vehicles and not so constructed as to carry any load thereon either independently or any part of the weight of a vehicle or load so drawn.
SAFETY ZONES:
The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone.
SCHOOL BUS:
Every motor vehicle owned or operated by or for any of the following entities for the transportation of persons regularly enrolled as students in grade 12 or below in connection with any activity of such entity: (i) any public or private primary or secondary school; (ii) any primary or secondary school operated by a religious institution; or (iii) any public, private or religious nursery school. A school bus does not include: (x) a bus operated by a public utility, municipal corporation, or common carrier authorized to conduct local or interurban transportation of passengers when such bus is not traveling a specific school bus route but is on a regularly scheduled route for the transportation of other fare paying passengers; furnishing charter service for the transportation of groups on field trips or other special trips or in connection with other special events; or being used for shuttle service between attendance centers or other educational facilities; (y) a motor vehicle of the first division; or (z) a multifunction school-activity bus.
SEMITRAILER:
Every vehicle without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle.
SIDEWALK:
That portion of a street between the curb line or roadway and the adjacent property line designated for pedestrian use.
SOLID TIRE:
Every tire of rubber or other resilient material which does not depend upon compressed air for the support of the load.
STREET OR HIGHWAY:
The entire width between boundary lines of every way publicly maintained, when any part thereof is open to the use of the public for the purpose of vehicular traffic.
TRAFFIC:
Pedestrians, ridden or herded animals, vehicles and other conveyances whether singly or together while using any highway for the purpose of travel.
TRAILER:
Every vehicle without motive power in operation, other than a pole trailer, designed for carrying passengers or property and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle.
TRUCK-TRACTOR:
Every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn, or a power unit that carries as property motor vehicles when operating in combination with a semitrailer in transporting motor vehicles or any other commodity, including cargo or general freight, on a backhaul.
URBAN DISTRICT:
The territory contiguous to and including any street which is built up with structures devoted to business, industry or dwelling houses situated at intervals of less than one hundred feet (100') for a distance of a quarter mile or more.
VEHICLE:
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway or requiring a certificate of title under Section 3-101(d) of the Illinois Vehicle Code, except devices moved by human power, devices used exclusively upon stationary rails or tracks and snowmobiles as defined in the Snowmobile Registration and Safety Act.
YIELD RIGHT OF WAY:
When required by an official sign the act of granting the privilege of the immediate use of the intersecting roadway to traffic within the intersection and to vehicles approaching from the right or left; provided, that when the roadway is clear the vehicle may proceed into the intersection.
