ORDINANCE AUTHORIZING A SPECIAL USE PURSUANT TO THE PETITION OF DIXON FAMILY YMCA
 
   WHEREAS, Dixon Family YMCA (the “Petitioner”) has submitted to the City Council of the City of Dixon (the “City Council”) a petition requesting a Special Use for the property located at 1675 Fulfs Lane, Dixon, Illinois, identified as permanent real estate index number 18-08-09-101-006, and legally described on Exhibit A attached hereto and incorporated herein (the “Property”); and
 
   WHEREAS, the owner of the Property, Dixon Land Group, LLC, an Illinois limited liability company, has consented to such petition; and
 
   WHEREAS, the Special Use that has been requested is to allow a child care center on a property zoned B-2 – General Business District under the City of Dixon’s zoning ordinance pursuant to Section 6-10-3(C)8 of the City Code for the City of Dixon (the “City Code”); and
 
   WHEREAS, the use the Property for such purpose is a matter for which Special Use status may be granted under the City Code; and
 
   WHEREAS, the Plan Commission for the City, after conducting a public hearing, has recommended to the City Council that a Special Use to allow a child care center pursuant to Section 6-10-3(C)8 of the City Code be granted for the Property pursuant to the request of the Petitioner; and
 
   WHEREAS, the City Council concurs in the recommendation of the Plan Commission for the City.
 
   NOW, THEREFORE, BE IT ORDAINED by the City Council that a Special Use be granted for the Property for a child care center pursuant to Section 6-10-3(C)8 of the City Code.
 
   BE IT FURTHER ORDAINED that the Special Use granted herein shall run with the land.
 
   BE IT FURTHER ORDAINED that the Special Use granted herein shall be listed on Appendix C and filed with the City Clerk of the City as provided in Section 6-13-18 of the City Code.
 
   BE IT FURTHER ORDAINED that the City Council hereby finds that all of the recitals contained in the preambles to this Ordinance are full, true and correct and does incorporate them into this Ordinance by this reference.
 
   BE IT FURTHER ORDAINED that the provisions and sections of this Ordinance shall be deemed to be separable, and the invalidity of any portion of this Ordinance shall not affect the validity of the remainder.
 
   BE IT FURTHER ORDAINED that all ordinances and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.
 
   BE IT FURTHER ORDAINED that the City Clerk is hereby directed to publish this Ordinance in pamphlet form.
 
   BE IT FURTHER ORDAINED that this Ordinance shall be in full force and effect from and after its passage and approval and publication, as required by law.
