3-2-7: APPLICATION PERMIT; REQUIREMENTS:
The application and permit shall state that the person to whom the permit shall be issued agrees to prosecute the excavation work, and backfilling with the utmost vigor, with as little delay and inconvenience to the public and the city as possible, in strict conformity with the provisions of this code, with provisions of all barricades, flares, lights, signs, and any other safeguards as are necessary or shall be deemed necessary by the building official; the person desiring to obtain an excavation permit shall further agree to remove all surplus materials of whatever nature from the excavation site and restore the site to as good or better condition than existed before excavation commenced, to perform all work in conjunction with the particular excavation so as to comply with all requirements as shall be set forth by this code, to hold and save harmless and indemnify the city, its agents, officers, and employees from any liability or responsibilities for damages to any person or property injured by the performance of any excavation work or by the carelessness or neglect of the person to whom the permit shall be issued or persons to whom the permit shall have been issued. All permits issued pursuant to this chapter shall expire ninety (90) days after date of issuance. Upon request, the building official may grant an extension at the time of issuance for jobs which would require additional time. No extension shall be permitted to extend beyond three hundred sixty five (365) days from the date issued. (Ord. 2781, 5-3-2010)
