It shall be unlawful for any parent or guardian of a minor to knowingly permit a minor to violate any provision of this subchapter.

ABANDONED SHOPPING CARTS
Any shopping cart found abandoned upon the highways, streets, alleys, sidewalks, or other public property, or on private property visible from public property, is hereby declared to be a public nuisance. A shopping cart shall be considered abandoned if the cart is not retrieved within 24 hours of the city receiving notice of the cart's location. The failure of the owner to retrieve the shopping cart shall be considered an abandonment of the cart. An abandoned shopping cart may be impounded by the city.

Within seven business days of impounding a cart, the city shall provide notice to the owner of the impounded cart, if identifiable, of the impoundment. The notice shall set forth the number of carts that were impounded and shall direct the owner to redeem the carts within 15 calendar days from the date of the notice.

An owner who redeems an impounded cart shall pay to the city an administrative fee per cart to cover the costs expended by the city for retrieving the cart, notifying the owner, and storing the cart. The City Council will establish an administrative fee by resolution or ordinance. The fee imposed by this section shall be in addition to any other fee or penalty that is imposed.

Impounded carts that are not redeemed within the time period set forth § 75.02 may be disposed of by the city. Where the owner of the cart is not identifiable, the city may dispose of the cart 15 calendar days after the impoundment.

GRAFFITI
(A) It is unlawful for any person to place graffiti upon the surface of any structure or wall that is publicly or privately owned without the permission of the owner of the property.
(B) It is unlawful for any parent or guardian of a minor to knowingly permit a minor to violate any provisions of this subchapter.
(C)
It is unlawful for any owner of property to place or give permission to place on any property, real or personal which is in public view, any graffiti which incites violence by reference to gang or criminal activity, depicts or expresses obscenity by referring to sexual activity, or contains defamatory material about a public or private person or which mark out gang jurisdiction for purposes of designating territorial rights of gangs for criminal activity.
(D) It is unlawful for any owner of property to fail to remove graffiti that has been placed on the owner’s property or fail to assign their obligation to remove the graffiti to the Police Chief’s office within three days from the date of the receipt of the written notice provided by the Police Chief’s office.
