§ 112.03 PERMIT REQUIREMENTS.
   (A)   Prior to the issuance of a junkyard operation permit, the operator of a junkyard must satisfy the following requirements.
      (1)   Existing junkyards. Junkyards in existence prior to the effective date of this chapter shall be issued a junkyard operation permit if:
         (a)   The junkyard is a legal non-conforming use on the effective date of this chapter;
         (b)   The junkyard is enclosed on all sides by a visual screen consisting of a fence with the fence being located no closer than 25 feet from any public right-of-way bordering the junkyard, and no closer than 15 feet from all other property lines of the parcel or parcels of property upon which the junkyard is located. (All initial applications for a junkyard operation permit must be accompanied by a detailed description of the materials to be used in construction of the fence, as well as a description of the manner in which the fence will be installed or erected.);
         (c)   All junk in the junkyard is stacked, stored or maintained within the screened area of the property;
         (d)   No junk is stacked, stored or maintained at a height greater than seven feet measured from the surface of the ground, and in such a way as to prevent the pooling of water; and
         (e)   All entrances to the junkyard are equipped with a gate or gates of at least eight feet in height capable of being securely locked.
      (2)   New junkyards. No person who establishes a junkyard following the effective date of this chapter shall be issued a junkyard operation permit unless:
         (a)   The operator has acquired a special use permit to establish the proposed junkyard in an Industrial District or a Rural Development 1 District;
         (b)   The proposed junkyard is located at least 1,000 feet from any dwelling used as a residence, school, place of public worship, day care center, nursing home or hospital;
         (c)   The proposed junkyard is located at least 100 feet from any public right-of-way;
         (d)   The proposed junkyard is enclosed on all sides by a visual screen consisting of a fence with the fence being located no closer than 25 feet from the property lines of the parcel or parcels of property upon which the proposed junkyard is located. (All initial applications for a junkyard operation permit must be accompanied by a detailed description of the materials to be used in construction of the fence, as well as a description of the manner in which the fence will be installed or erected.);
         (e)   All junk on the property of the junkyard is stacked, stored or maintained within the screened area of the property;
         (f)   No junk is stacked, stored or maintained at a height greater than seven feet measured from the surface of the ground; and
         (g)   All entrances to the junkyard are equipped with a gate or gates of at least eight feet in height capable of being securely locked.
   (B)   The restrictions contained in this section are only minimum requirements and greater restrictions may be imposed as conditions of obtaining a special use permit.
