Equipment which was installed in a food service establishment or retail food store prior to the effective date of these rules, and which does not meet fully all of the design and construction requirements of this section, shall be deemed acceptable in the facility if the equipment is in a state of good repair, capable of being maintained in a sanitary condition, and all food contact surfaces of the unit are considered non-toxic.  Such equipment shall be so located and installed as to enable reasonable compliance with all requirements pertaining to equipment installation, and all requirements pertaining to food protection.
