A. Enforcement:
1. It shall be unlawful for any person to be in control of, to drive, to park, or to move on, upon or across or for the owner to cause or knowingly permit to be parked, to be driven, or to be moved upon or across, any street or highway under the jurisdiction of this city, any vehicle or combination of vehicles exceeding the size and weight limitations stated in 625 Illinois Compiled Statutes 5/15-102 (width), 5/15-103 (height), and 5/15-111 (weight).
2. Size and weight limitations while operating on city streets shall not apply to fire apparatus or equipment for garbage, snow or ice removal operations owned or operated by or for any governmental body or to implements of husbandry temporarily operated or towed in a combination in the furtherance of a farm or agricultural endeavor or to public passenger vehicles of common carriers operating under a certificate of necessity and convenience issued by the Illinois commerce commission and to any vehicle or combination of vehicles operating under the terms of a valid oversize and/or dimension permit issued by this city.
3. In addition to the size and weight restrictions contained in subsection A1 of this section, the city may further restrict size and weight limitations by ordinance pursuant to 625 Illinois Compiled Statutes 5/15-316. Such further restrictions shall be effective once said ordinance is passed and signs containing said restrictions are posted. Thereafter, it shall be unlawful to operate any vehicle or combination of vehicles in violation of such size or weight restrictions.
4. It shall be unlawful for any person to operate or cause to be operated any vehicle on the streets of this city in violation of the provisions of this section. Members of the city's police force shall see to the enforcement of this section by issuing citations and/or arresting violators. (Ord. T-8-95, 8-21-1995)
5. The owner and operator of any vehicle that violates any provision of this section, each shall be subject to a fine as provided in the general penalty in section 1-4-1 of this code for each violation. Each day that a violation is found to exist shall constitute a separate violation. (Ord. T-8-95, 8-21-1995; amd. 2002 Code)
B. Load Limitations:
1. Eighty Thousand Pounds Maximum Weight: The following streets or parts thereof are designated as eighty thousand (80,000) pounds gross vehicle weight (GVW) maximum load limitation for "class II highway vehicles", as defined in 625 Illinois Compiled Statutes 5/15-111(f):

C. Registered And Gross Weight Not To Exceed Eight Thousand Pounds: All city streets, except as provided for in subsection B of this section, shall have the following weight restrictions:
1. Registered gross weight not to exceed eight thousand (8,000) pounds' gross vehicle weight (GVW) (nothing above a B plate).
2. Gross weight, including load, not to exceed eight thousand (8,000) pounds' gross vehicle weight (GVW).
However, any vehicle exceeding the eight thousand (8,000) pound gross vehicle weight (GVW) weight limitations required to make a delivery or pick up at a place of residence or business along said streets may do so, but said vehicle shall move along said street from the nearest point of entry to the place of pick up or delivery and shall leave said street at the intersecting street nearest said point of delivery or pick up.
D. Special Permits For Overload Trucks: When, in his judgment an emergency exists, the director of finance and administrative services (or his designee) may, in his discretion, issue a special permit authorizing the applicant to operate or move a vehicle or combination of vehicles of a size or weight of vehicle or load exceeding the maximum specified in the laws of the state of Illinois or otherwise not in conformity with the provisions of this section, upon any street or highway under the jurisdiction of the city. The application shall be in writing and shall specifically describe the vehicle or vehicles and load to be operated or moved and the particular streets or highways for which the permit to operate is requested. The application shall also specify if the permit is requested for a single trip or for continuous operation.
The director of finance and administrative services, or his designee, is authorized to issue or withhold such permit at his discretion; or, if such permit is issued, to limit the number of trips, or to establish seasonal or other time limitations within which the vehicle described may be in operation on the streets or highways indicated, or otherwise to limit or prescribe conditions of operation of such vehicle or vehicles, when necessary to assure against undue damage to the road foundations, surfaces or structures, and may require such undertaking or security as may be deemed necessary to compensate for any injury to any roadway or road structure.
A permit for a single trip shall be valid for thirty (30) days following its issuance, and the fee for such a permit shall be thirty five dollars ($35.00). A round trip permit shall be seventy dollars ($70.00). A multiple routing permit shall be valid for one hundred (100) days and the fee for such a permit will be one hundred fifty dollars ($150.00). A permit for continuous operation for one year shall be five hundred dollars ($500.00).
Every permit issued under the provisions of this section shall be carried in the vehicle or combination of vehicles to which it refers and shall be open to inspection by any police officer. (Ord. T-6-05, 4-18-2005)
