A. Purpose: The purpose of this section is to protect the public health, safety and welfare of the citizens of the city from conduct which includes, but is not limited to, dangerous traffic congestion, excessive noise and pollution resulting from cruising, and to ensure sufficient access for emergency and police vehicles, by reasonable time, place and manner restrictions consistent with substantive due process of law.
B. Definitions: The following definitions shall apply in the administration and enforcement of this section:
CRUISING: Driving a motor vehicle, upon a public street or upon private property past a traffic control point as designated by the Des Plaines police department, more than twice in any one hour period.
CRUISING DESIGNATED AREA: All municipal parking lots owned by the city of Des Plaines, which include the following:

Municipal garage | 606 Lee |
Municipal garage | 1444 Prairie |
These designated areas shall be clearly marked with permanent fixed signs advising the public that the area is subject to regulation under this section.
PRIVATE PROPERTY: An area of public access to privately owned property where an enforcement agreement is in effect by and between the owner of the property and the city, under 65 Illinois Compiled Statutes 5/1-1-7 and 625 Illinois Compiled Statutes 5/11-209 and 5/11-209.1, or home rule powers of the city.
TRAFFIC CONTROL POINT: A clearly identified reference point within a designated area upon a public street or upon private property as determined and marked time to time by the Des Plaines police department. (Ord. M-38-95, 6-19-1995; amd. 2002 Code)
C. Offense: No person shall engage in "cruising" as defined herein.
D. Exclusions: This section shall not apply to any municipal, emergency, police, fire, ambulance or other governmental vehicles when same is being operated in an official capacity. In addition, this section shall not apply to any duly licensed public transportation vehicle nor to any vehicle utilized for business and/or commercial purposes. (Ord. M-38-95, 6-19-1995)
E. Penalty: Any person violating any of the provisions of this section shall be subject to a fine of not less than twenty five dollars ($25.00) nor more than the maximum fine provided for in the general penalty in section 1-4-1 of this code for each offense. (Ord. M-38-95, 6-19-1995; amd. 2002 Code)
