7-3-5: STANDING RESTRICTIONS:
   A.   Loading Operations:
      1.   No person shall stop, stand, or park any vehicle for any purpose or period of time other than for the expeditious loading or unloading of passengers in any place marked as a passenger loading zone during hours when the regulations applicable to such passenger loading zone are effective and then only for a period not to exceed three (3) minutes.
      2.   No person shall stop, stand, or park a vehicle for any purpose or length of time other than for the expeditious unloading and delivering or pick up and loading of materials in any place marked as a merchandise loading zone during hours when the provisions applicable to such loading zones are in effect. In no case shall the stop for loading and unloading of materials exceed thirty (30) minutes. (2-20-39)
      3.   No person shall stop, stand, or park an automobile carrier in a C-4 Commercial Central Business District or R-5 Residential Central Core Multiple- Family Residence District, for the purpose of loading or unloading automobiles. (Ord. M-51-92, 12-7-1992)
      4.   No drivers of intercity buses shall stop, stand, or park any intercity bus to load or unload passengers at any passenger loading zone or at any location in the City except as permitted by Section 7-3-5.D.
   B.   Standing Or Parking Close To Curb: No person shall stand or park a vehicle in a roadway other than parallel with the edge of the roadway or curb, headed in the direction of traffic, and with the two (2) right wheels of the vehicle within twelve inches (12") of the edge of the roadway or curb, except upon those streets which have been marked or indicated by signs for angle parking, vehicles shall be parked at the angle to the curb indicated by such mark or signs.
   C.   Standing Or Parking For Sale, Repair Or Advertising: No person shall stand or park a vehicle upon a roadway for the principal purpose of:
      1.   Displaying it for sale.
      2.   Washing, greasing or repairing such vehicle except repairs necessitated by an emergency.
      3.   Primary purpose of advertising. (2-20-39)
   D.   Intercity Bus Stops:
      1.   Definitions. For the purpose of this Subsection D, the terms used will have the definitions ascribed to them by the Illinois Vehicle Code unless otherwise specifically provided in this Subsection or unless the context clearly indicates or requires a different meaning. The following additional definitions apply unless the context clearly indicates or requires different meaning:
INTERCITY BUS: Any bus used for the one-way transportation of 10 or more passengers originating from a location outside of the City that is not a regularly scheduled service.
REGULARLY SCHEDULED SERVICE: Any bus involving passengers disembarking in the City on a predictable and recurring basis, following a schedule that is published in advance and available to the general public, and provides service in exchange for paying a fare.
UNSCHEDULED STOP: The stopping or standing of an Intercity Bus within the City for the purpose of unloading or the disembarking of passengers without prior approval of the City as required by Section 7-3-5D of this Code.
   2.   Prohibited: Unscheduled stops of intercity buses are declared to be a nuisance and are prohibited in the City.
   3.   Intercity buses may stop to allow passengers to disembark in the City only if they comply with all of the following conditions and restrictions:
      a.   Permitted Hours.
         (1)   Intercity buses may only stop or stand to allow passengers to disembark within the City between the hours of 7:00 a.m. and 4:00 p.m., Monday through Friday, but not on any federal, state, or City holidays;
         (2)   No intercity bus may allow passengers to disembark except within 30 minutes before or after the time designated in an application that has been approved pursuant to this Section 7-3-5.D.
      b.   Permitted Location. Intercity buses may only stop or stand to allow passengers to disembark within the City at the downtown Metra train station located at 1501 Miner Street;
      c.   Coordination of Disembarking Passengers: The intercity bus must be met by individuals responsible for coordinating the transportation of the passengers from the stop location in the City to their final destination(s); and
      d.   Advance approval: The owner, operator, or driver of an intercity bus must obtain advance written approval of the City prior to making a stop and allowing passengers to disembark within the City. In order to obtain advanced approval of a stop, the owner, operator, or driver of the intercity bus must submit an application to the Chief of Police or their designee at least five business days before the date of the proposed stop. The application must include the following information:
         (1)   The full name, full address, and telephone numbers, including mobile telephone numbers of the owner, operator, and driver of the intercity bus;
         (2)   The make, model, state registration/plate number, fleet number, and vehicle identification number (VIN) of the bus that will be providing the service;
         (3)   The number of passengers, including the number of minor children, proposed to disembark in the City of Des Plaines, as well as the direct contact phone number and email for the on-scene coordinator;
         (4)   The date and time of the proposed stop at which the applicant’s passengers will disembark in the City;
         (5)   Any additional information that the Chief of Police or their designee determines is required provided that such information is related to the purpose of this Section; and
         (6)   An affirmation by the applicant that the information provided in the application is true and correct. Such affirmation must be attested to by a person authorized to administer oaths or witness affirmations within the state or territory where the application is sworn to or affirmed.
         (7)   Review of Application. Upon receipt of the application for an intercity bus stop submitted pursuant to this Section, the Chief of Police will undertake a review of the information contained in the application to verify its truth and authenticity. If the application is incomplete, the Chief of Police will, in writing, advise the applicant of the additional items needed to complete the application. No later than three business days after receiving a completed application, the Chief of Police will inform the applicant, in writing, that the application is approved or denied for the proposed location of disembarkation in the City. A notice of denial will state the grounds for denial. Grounds for denial of an application may include the following:
            A.   The receipt of bona fide information that the application contains materially false or misrepresented information;
            B.   Existence of past-due fines for previous violations of this Section 7-3-5 by any entity listed on the application;
            C.   The failure to provide any of the information or meet the standards required by this Section 7-3-5;
            D.   Any extenuating factors that would increase the threat to public health and safety due to staffing or operational constraints.
         (8)   Revocation. The approval of an application pursuant to this Section may be revoked by the Chief of Police upon their determination that the application contains any false or misleading information.
         (9)   Proof of Application and Approval. The driver of an intercity bus approved pursuant to this Section 7-3-5.D. must have in their possession a physical or electronic copy of the approved application and present it for inspection at the stop location upon request by an employee or designee of the City.
      4.   Penalty. The owner, operator, or driver of any Intercity Bus that stops or unloads passengers in violation of this Section 7-3-5.D. is subject to a fine as set forth in Section 7-10-6 of this Code. (Ord. M-2-24, 1-16-2024)
