4-4-16: PROHIBITED SALES, ACTS 1
:
   A.   Sales To Persons Under Twenty One And Mental Incompetents: No licensee nor any officer, associate, member, representative, agent or employee of such licensee shall sell, give or deliver alcoholic liquor to any person under the age of twenty one (21) years, or to any intoxicated person or to any person known by him to be a habitual drunkard, a spendthrift, insane, mentally ill, mentally deficient or in need of mental treatment. No person, after purchasing or otherwise obtaining alcoholic liquor, shall sell, give or deliver such alcoholic liquor to another person under the age of twenty one (21) years, except in the performance of a religious ceremony or service.
   B.   Premises To Display Warning To Minors: Every place in the city where alcoholic liquor is sold shall display at all times in a prominent place a printed card which shall be issued by the liquor control commissioner and which shall read substantially as follows:
         WARNING TO PERSONS UNDER
         THE AGE OF TWENTY ONE
You are subject to a fine as provided in the general penalty in section 1-4-1 of the city code of the city of Des Plaines if you purchase alcoholic liquor or misrepresent your age for the purpose of obtaining the alcoholic liquor if you are under the age of twenty one (21) years.
   C.   Loitering By Persons Under Twenty One: No licensee shall permit any person under the age of twenty one (21) years to be or remain in any room or compartment adjoining or adjacent to or situated in the room or place in which the licensed premises is located; however, this provision shall not apply to any person under the age of twenty one (21) years who is accompanied by his parent or guardian, or to any licensed premises which derives its principal business from the sale or service of commodities other than alcoholic liquor.
   D.   Parental Responsibility: Any parent or guardian who shall knowingly permit any person under the age of twenty one (21) years of which he may be the parent or guardian to violate any provision of this chapter shall, upon conviction, be subject to a fine as provided in section 1-4-1 of this code for each and every such offense. For purposes of this subsection, "knowingly" shall be defined as in section 6-3A-1 of this code.
   E.   Misrepresentation Of Age: It shall be unlawful for any person under the age of twenty one (21) years to misrepresent his age for the purpose of purchasing or obtaining alcoholic liquor in any place in the city where alcoholic liquor is sold.
   F.   Application Of Provisions To Minors: No person under the age of twenty one (21) years shall purchase, accept as a gift, possess or consume any alcoholic liquor in any licensed liquor premises or in any public or private place. These prohibitions shall apply to such person on any street or highway or in any public place or in any place open to the public and shall not apply in the performance of a bona fide religious service or ceremony or whenever the person is under the direct supervision and approval of a law enforcement officer acting within his official duties.
