§ 94.04 NOTICE; HEARING.
   (A)   The City Recorder shall give notice by certified or registered mail, return receipt requested, or personal service, to the owner of the property. It shall be deemed noticed to the owner or owners where such notice is given to the person or delivered by mail to the address listed by the county tax office for mailing of the tax statement.
      (1)   The notice shall state, in general terms, that a hearing will be held by the City Council concerning the suspected nuisance of the property, and a time and place thereof.
      (2)   A copy of this notice shall also be posted on the ten days’ notice of this hearing shall be published in a newspaper of general circulation in the city or by posting said notice in three public places in the city.
      (3)   If notice is published or posted as provided herein, no irregularity or failure to mail notice to an owner of record shall invalidate the proceedings.
   (B)   The notices to be published, posted, and mailed giving notice of any hearing required shall be in substantially the following form:

You are hereby notified that a driveway to the premises above-mentioned have been reported to the City Council as diverting, obstructing, or altering the collected flow of water in a channel, drainage ditch, or similar means of collected flow, and as a result water flows, collects, or traverses upon a roadway and creates a hazard or inconvenience to the orderly movement of persons or traffic upon the roadway, or is likely to cause or has caused damage to the roadway.
The Council has scheduled a public hearing on the        day of                      20    , at           , to consider if a nuisance exists. If the Council determines that the property is creating, permitting, or suffering a nuisance to occur as aforesaid, it may order a culvert installed, or such other appropriate action as is deemed appropriate. In that event, all costs incurred by the city will be borne by the owner.
