§ 70.25 COUNTY SHERIFF’S OFFICE TO ACT AS SEIZING AGENT.
   (A)   Pursuant to O.R.S. 809.730 (relating to forfeiture of certain vehicles being driven by persons who are under the influence of intoxicants, which has been codified as Lincoln County Code §§ 2.3000 and 2.3005, and as those code sections may later be amended by subsequent ordinance of the County Board of Commissioners) shall apply within the city.
   (B)   The County Sheriff’s Department may act as the “seizing agency” for purposes of application of the county ordinance described in division (A) above within the city.
   (C)   The County Board of Commissioners may also enter into an intergovernmental agreement pursuant to O.R.S. Chapter 190 with the state police that permits the state police to also act as a “seizing agency” for purposes of application of the county ordinance described in division (A) above within the city.
   (D)   The county, a political subdivision of the state, may act as the “forfeiting agency” for purposes of application of the county ordinance described in division (A) above within the city.
   (E)   The office of county legal counsel may act as “forfeiture counsel” for purposes of application of the county ordinance described in division (A) above within the city.
   (F)   By exercise of the county ordinance described in division (A) above by the county, and enforcement thereof, the county shall indemnify, hold harmless, and defend the city against any costs or claims arising out of or resulting from any vehicle forfeiture by the county as permitted by this section.
