§ 53.03 CLOSURE OF AGATE BEACH LANDFILL FEE.
   (A)   There is hereby established a fee on waste generated with the city, such fee to be known as the Agate Beach closure fee. Such fee shall be set from time to time by resolution of the City Council, in such amount as will result in the accumulation of sufficient funds to pay the proportional share of the city of the closure and post-closure costs associated with the Agate Beach landfill site, and/or as will provide the city’s proportional share of an income source adequate to permit the issuance, sale, and repayment of revenue or other bonds sufficient to pay such closure and post-closure costs.
   (B)   Any such Agate Beach closure fees so imposed and received by the city shall be deposited to a special revenue fund to be established for such purpose, to be used exclusively for the city’s proportional share of closure and post-closure costs of the Agate Beach landfill. When such costs have been fully and adequately funded, the imposition and collection of this fee shall be terminated.
   (C)   Such fee shall be in addition to, and not in lieu of, any other fee, charge, or cost imposed upon the franchisee, solid waste, or upon solid waste generators, under the provisions of this section or otherwise. Such fee is imposed with respect to solid waste collected within the city on or after 12:01 a.m. September 11, 1993.
