A. The office of mayor or councilman shall be deemed vacant upon the incumbent’s death; adjudicated incompetence; conviction of a felony, other offense pertaining to his office, or unlawful destruction of public records; or recall from office.
B. The office of mayor or councilman shall also be deemed vacant upon declaration by the council after the incumbent’s resignation; or ceasing to be a qualified elector of the city under state law; failure of the person elected or appointed to the office to qualify therefore within ten (10) days after the time for his term of office to commence; ceasing to reside in the city; absence from the city for thirty (30) days without the consent of the council; or absence from meetings of the council for sixty (60) days without the consent of the council.
