122.09 UNIQUE REQUIREMENTS FOR MOBILE FOOD UNIT VENDORS AND TRANSIENT MERCHANTS.
      1.   Mobile Food Unit License. Mobile food unit vendors need to provide a copy of their Mobile Food Unit License from the State of Iowa Department of Inspections and Appeals.
      2.   Insurance. Before a license under this chapter is issued to a mobile food unit vendor or transient merchant, an applicant shall provide to the Clerk proof of liability insurance, including commercial general liability insurance coverage and automotive liability insurance coverage.
      3.   Retail Sales Tax Permit. Before a license under this chapter is issued to a mobile food unit vendor or transient merchant, an applicant shall provide to the Clerk a copy of the applicant's Iowa retail sales tax permit or a retailer's use tax permit.
      4.   Disposal of Waste, Oil, and Grease. Mobile food unit vendors and transient merchants are responsible for keeping and maintaining the area around and within fifty (50) feet of their unit neat, clean, and free from trash, debris, garbage, and other hazardous conditions at all times regardless of whether the trash, debris, or garbage originated from the operation or was left in the area by a pedestrian passerby or natural conditions. Mobile food unit vendors and transient merchants shall provide adequate trash receptacles for the public for all garbage from its operation and from the accumulation of garbage in the area around the unit at all times the unit is in operation. At the close of its daily business, the unit must remove all garbage, oil, and grease from the area and properly dispose of it away from the site of its operation; the garbage shall not simply be placed in nearby public garbage receptacles provide for use to the general public at large.
      5.   Single Use Food Service Containers. Mobile food units shall only use single use service food containers, cups, straws, utensils, stirrers, plates, bowls, wrappers, containers, and similar items. Such items shall be individual wrapped if usual and kept in a clean place only to be used once in the service of food and/or beverage.
      6.   Noise / Sound. No mobile food unit or transient merchant shall operate in a manner that violates Chapter 41 of the City of Denison Code of Ordinances concerning noise, including making any noise or using any device to call attention to the unit's location and operation.
      7.   Unit Removal at End of Day. No mobile food unit or transient merchant shall be left at its operating location at the end of its business day and shall be removed to its base business operation location. Vendors operating as part of the Special Event Permit may leave their units in place for the duration of the event.
      8.   Electricity and Water. Mobile food units and transient merchants must provide their own electricity and water sources. If necessary, any hookups to electricity and/or water will be coordinated with and paid for through Denison Municipal Utilities.
      9.   No Mobile Food Unit should provide or allow any dining area, tables, chairs, booths, benches, bar stools, stand-up counters, or similar furniture unless allowed by a private lease on private property, or provided as part of the Special Event Permit.
      10.   No Mobile Food Unit shall be used for any purpose other than as a Mobile Food Unit offering food and/or beverage to customers.
