122.08 LOCATION RESTRICTIONS..
      1.   Mobile food units and transient merchants cannot be located on city property, including the city's right-of-way without permission.
         A.   Mobile food units and transient merchants who wish to occupy parking spaces must have prior written consent of business owners within 20 feet of said parking spaces.
         B.   Sales shall be conducted on the sidewalk side of the mobile food unit whenever possible away from moving vehicles, except when done in conjunction with an event that has requested the street to be closed.
         C.   Food Trucks permitted to be located on City Property or City Parks are limited to 3 (three) day(s) per location.
         D.   A limited number of mobile food units and transient merchants may be located in city parks with approval of the governing board of said park.
         E.    Mobile food units are not permitted at any city park location during hours that city ran concessions are open.
      2.   Mobile food units must be located at least 10 feet from each other.
      3.   Mobile food units must be located a minimum of 200 feet away from permanent food establishments during their operating hours. For the purposes of this section, bars that serve food are considered to be food establishments. An exception may be made if a food truck has been invited and approved in writing by a permanent food establishment.
      4.   During Special Events permitted under Chapter 126 of the City of Denison Code of Ordinances, Mobile Food Units not directly involved with the sponsoring organization shall not be located within 1,200 feet (3 city blocks) of that event.
      5.   Mobile food units using deep fat fryers or open flame cooking shall be located 20 feet away from any business or other mobile food unit.
      6.   Mobile food units or transient merchants shall not conduct operations at a location or in a manner that hinders, impedes, or restricts access to a mailbox, traffic control box, fire hydrant, or entrance to a driveway or building. The city reserves the right to require to move a mobile food unit or transient merchant from any location if determined to be necessary for the provision of emergency or public services, or in the interest of public safety, peace, and welfare.
