Whenever any authorized municipal officer finds that a nuisance exists, such officer has the authority to determine on a case-by-case basis whether to utilize the nuisance abatement procedure, or the municipal infraction procedure, or both. Nothing in this chapter shall be construed as requiring a municipal officer to utilize one enforcement procedure over another. All municipal officers can decide, on a case-by-case basis, which enforcement procedure is appropriate for that particular circumstance. Utilizing one enforcement procedure does not prohibit the municipal officer from also utilizing the other. 2
