It shall be unlawful for any person to obstruct or encumber by fences, building structures, display of merchandise or articles, or substance of any kind, a public sidewalk, ground, boulevard, highway, street or alley of the Municipality, or being the owner, occupant or person having the care of any building or lot of land bordering on any street or highway, to maintain or permit to remain such fences, building structures, display of merchandise or articles, or substance of any kind, so as to interfere with the free and unobstructed use thereof of a public sidewalk, ground, boulevard, highway, street or alley of the Municipality.

(a) For the purpose of this section, “new street” means any newly created (named) street and shall not include any street presently established as a street.
(b) Curbs shall be required for any new streets constructed within the Village and the curbs shall be subject to the following requirements:
(1) The curbing must consist of stone, cast in place, precast concrete, and the curbing must comply with Item 609 of Construction and Material Specifications Manual, Department of Transportation, State of Ohio, dated January 1, 1977 and any revisions thereafter.
(2) Prior to the commencement of construction of the curbing, the construction of the curbing must be approved by Council and the Administrator.

The minimum requirements for cutting any street within the Village shall be as follows:
(a) Prior to the time a contractor cuts any street within the Village, the contractor must first post a one hundred fifty dollar ($150.00) deposit with the Village Clerk’s office.
(b) Permission to cut any street must be given in writing to the contractor by the Administrator.
(c) The cut in the street must be backfilled with #6 or #411 stone or sand, tamped in eight inch lifts, to a depth eight inches less than the level surface of the street.
(d) The edges of the hole must be saw cut to provide a neat patch.
(e) The actual patch shall be a concrete patch no less than eight inches thick.
(f) The use of rerod or iron mesh shall be determined by the size of the patch. The Village Administrator or the Street Superintendent shall determine whether or not the use of rerod or iron mesh will be required.
(g) The concrete shall be air-entrained six-bag mix with a broom finish.
(h) The concrete patch shall be in place within twenty-four hours following work completion.
(i) The contractor shall be responsible for the placement of any warning devices necessary to protect the public health, safety and welfare.
(j) In the event any contractor does not patch a cut in the street, the Street Department shall place the patch to the aforementioned specifications and charge the contractor twenty dollars ($20.00) per hour per man and twenty dollars ($20.00) per hour per piece of equipment used. The total charge will be deducted from the one hundred fifty dollar ($150.00) deposit and the remaining balance, if any, shall be deposited to the Village Street Fund.
