§ 157.19  LOT AREA, YARD AND BULK REGULATIONS.
   (A)   General provisions. In any district in which single-family dwellings are permitted, a single-family dwelling and customary accessory buildings may be erected on any single nonconforming lot of record  (see § 157.51 of this chapter). Bulk refers to the height and lot coverage for structures in specific districts. The table in division (G) lists the lot area, yard, and bulk regulations for the designated districts.
   (B)   Front yards.
      (1)   Generally. Where 30% or more of a block front is improved with buildings, then no part of any building shall project beyond a line joining the two adjacent corners of the building on either side thereof, or where there is a building on only one side, beyond a line projected from the corresponding adjacent corner of the building except that no building shall be required to provide a front yard greater than 50 feet in any event.
      (2)   Divided block front. Where a block front is divided among districts with different front yard requirements, the deepest front yard required shall apply to the entire block front.
      (3)   Corner lot. On corner lots there must be a front yard on both streets. However on corner lots that are lots of record, the buildable width cannot be reduced to less than 28 feet except that there shall be a yard along the side street of such a lot of at least five feet.
      (4)   Double frontage lots. On double frontage lots, such as, lots fronting on two nonintersecting streets, a front yard must be provided on both streets.
      (5)   Landscaping. Front yards shall be devoted entirely to landscaped areas and the necessary paving of driveways and sidewalks to reach parking or loading areas in the side or rear yards.
      (6)   Other restrictions. See division (E) of this section for other restrictions.
   (C)   Rear yards.
      (1)   A detached accessory building located more than ten feet from the main building shall be built within the side yard required for the main building and shall be located at least five feet from the rear lot line.
      (2)   A detached accessory building located ten feet or closer from the main building or an attached accessory building shall be platted with the side and rear yards required for the main building.
      (3)   Swimming pools and home barbecue grills may occupy a rear yard provided that they are not located closer than five feet to the rear lot lines or closer than five feet to a side lot line on interior lots.
      (4)   See division (E) of this section for other restrictions.
   (D)   Side yards.
      (1)   Size requirements. Required side yards shall be maintained on each side of the dwelling but such side yard may be decreased to 10% of the lot width on lots of less than 70 feet in width, provided, however, that no required side yard shall be less than five feet.
      (2)   Exceptions. No side yard shall be required where dwellings are erected above commercial structures, except such side yards as may be required for a commercial dwelling in the district in which it is located. If a variance or a conditional use permit has been issued, the side yards stipulated therein shall be required.
      (3)   Corner lots. On corner lots there must be a front yard on both streets. However, on corner lots that are lots of record, the buildable width cannot be reduced to less than 28 feet except that there shall be a yard along the side street of such a lot of at least five feet. On a corner lot, any lot line or yard not considered a front lot line or yard shall be a side lot line or side yard.
      (4)   Two-family or multi-family dwellings. For purposes of the side yard regulations, a two-family dwelling unit or multi-family dwelling unit  shall be  considered one building occupying one lot.
      (5)   Three-story multi-family buildings. For three-story multi-family buildings, eight-foot side yards are required.
      (6)   Semi-public buildings. Schools, libraries, churches, public and other semi-public buildings in residential districts. The minimum width of side yards for schools, libraries, churches, community buildings, and other public and semi-public buildings in RU, RS, RC, and RD districts shall be 25 feet, except where a side yard is adjacent to a commercial or industrial district in which case the width of the yard required in the adjoining district shall be required for that yard.
      (7)   Accessory buildings. An accessory building shall be provided with yard required for the main building.
      (8)   Recreational restrictions. Swimming pools and home barbecue grills may occupy a rear yard provided that they are not located closer than five feet to the rear lot lines or closer than five feet to a side lot line on interior lots.
      (9)   Other restrictions. See division (E) of this section for other restrictions.
   (E)   All yards.
      (1)   Sills, window air-conditioning units, chimneys, roofs, cornices, and ornamental features may project into a required yard a distance not to exceed 24 inches.
      (2)   Open fire escapes and fireproof outside stairways and ordinary projections of chimneys and flues into a required yard for a distance of not more than three and one-half feet may be permitted when so placed as to not obstruct light and ventilation.
      (3)   Those parts of existing buildings that violate yard requirements may be repaired and remodeled in accordance with § 157.52 of this section, but not reconstructed or structurally altered in such a way as to increase their nonconformity.
      (4)   Filling station pumps and pump islands may occupy required yards provided, however, that they are not less than 15 feet from all lot lines.
      (5)   In the B and I-1 Districts there may be more than one building on a lot provided that the required yards be maintain around the group of buildings.
      (6)   There may be two or more related multi-family hotel, motel or institutional buildings on a lot provided that:
            (a)   The required yards be maintained around the group of buildings; and
            (b)   Buildings that are parallel be separated by a horizontal distance that is at least equal to the height of the highest of the parallel buildings.
   (F)   Height regulations.
      (1)   Maximum height limits established for buildings and structures are as follows:
            (a)   Thirty-five feet in the RU, RC and RS Districts; and
            (b)   Forty-five feet in the RD, B, and I-1 Districts.
      (2)   The above height limits may be exceeded in the following instances:
            (a)   Public, semi-public or public service buildings, hospitals, institutions, agricultural buildings, or schools when permitted in a district, may be erected to a height not exceeding 110 feet, and churches may be erected to a height not exceeding 75 feet if the building is set back from each yard line at least one foot for each foot of additional building height above the height limit otherwise permitted in the district in which the building is built; and
            (b)   Television and radio towers, church spires, belfries, monuments, tanks, water and fire towers, stage towers or scenery lofts, cooling towers, ornamental towers and spires, chimneys, elevator bulkheads, stacks, conveyors and flag poles may be erected to such height as may be authorized by the Village Board.
