§ 157.52  NONCONFORMING STRUCTURES.
   (A)   Definition. A NONCONFORMING STRUCTURE is one which was legally constructed prior to the effective date of this chapter or subsequent amendment thereto, which would not be permitted as a new structure under the terms of this chapter because such structure is not in conformance with the yards, height, coverage or other requirements of the district in which it is located. A structure located on a nonconforming recorded lot is not classified as a nonconforming structure solely because of insufficient lot area or width, nor shall anything herein be construed to affect those structures previously covered in § 157.51 of this section.
   (B)   Destruction of nonconforming structures. Should a nonconforming structure or nonconforming portion of structure be destroyed by any means to an extent of more than 50% of its fair market value at time of destruction, it shall not be reconstructed except in conformity with the provisions of this chapter. Damage to an extent less than that described above shall be repaired in a manner as nearly conforming as possible.
   (C)   Moving nonconforming structures. Should a nonconforming structure be moved for any reason for any distance whatever, it shall thereafter conform to the regulations for the district in which it is located after it is moved.
