147.23 SURETY BONDS OF PUBLIC OFFICIALS AND EMPLOYEES.
   (a)   The Municipality shall maintain General Liability Insurance providing not less than $7,500,000.00 in coverage for the protection of the municipality, its officers and employees, against claims predicated on alleged errors or omissions in the conduct of governmental and proprietary functions. The municipality shall maintain Crime Insurance providing not less than $500,000.00 protection against loss resulting from acts of employee dishonesty by public officials and employees. Insurance coverages required by this section shall extend to all officers and employees of the Municipality including, without limitation, the Clerk and Bailiff of the Defiance Municipal Court. The required coverages shall be obtained through the Buckeye Ohio Risk Management Agency at public expense and paid from moneys annually appropriated for contribution to the municipal risk pool.
   (b)   Surety Bonds conditioned on faithful performance of duty by the Clerk and Bailiff of the Defiance Municipal Court shall be maintained at public expense in the minimum amount required to achieve compliance with Title 19 of the Ohio Revised Code.
   (c)   Except as provided in subsection (b) hereof, elected and appointed officials and employees shall not be required to post a surety bond as a condition of service or employment. The inability of the Municipality to obtain employee dishonesty coverage required by subsection (a) hereof for any person due to that person’s personal criminal or credit history shall, however, be deemed sufficient grounds for removal of that person from any appointed office or employment for which a surety bond is required by General Law.
