1333.26 NONLIABILITY OF CITY.
   (a)    The land use restrictions and construction standards established by this Chapter are enacted solely for regulatory purposes in the discharge of necessary governmental functions described by Ohio Revised Code Section 2744.01 (C)(2)(r). The degree of flood protection required by this Chapter is considered reasonable for regulatory purposes based on scientific and engineering considerations assuming that lands will be subject to the generally prevailing conditions of the base flood. More severe floods have occurred and will again occur in the City and man-made or natural conditions may cause localized variations in water surface elevation or floodwater velocity. Lands located outside designated areas of special flood hazard may be subject to flooding. Structures within and without areas of special flood hazard may sustain flood damage notwithstanding compliance with all requirements of this Chapter. No provision of this Chapter shall be construed to imply that lands located outside designated areas of special flood hazard are free from the risk of flood or that compliance with the requirements of this Chapter will assure the safety or persons or property.
   (b)   Nothing in this Chapter shall be construed to waive or limit the scope of immunity from suit accorded the City and its officers and employees by Ohio Revised Code Section 2744.02. No provision of this Chapter shall be construed to create liability on the part of the City or its officers or employees for any harm allegedly caused by compliance with a regulatory requirement of this Chapter or any administrative order issued pursuant to this Chapter or allegedly resulting from inadequate enforcement of this Chapter.
