(a) Except as provided by Section 1333.11(e)(1), the Commissioner shall not grant a permit authorizing development within the boundaries of a floodway unless the application is supplemented by hydrologic and hydraulic evidence demonstrating that the proposed development will not increase water surface elevation during the occurrence of the base flood.
(b) The Commissioner shall not consider hydrologic or hydraulic evidence tending to establish compliance with the requirements of Paragraph (a) of this Section unless a licensed hydraulic engineer or registered professional engineer certifies the general acceptance of the analytic methodology employed and the accuracy of all computations.
