(1) To limit the discretion vested in the Planning Commission to disapprove a proposed plat for the reason that land is unsuitable for development due to flooding, bad drainage or other topographic conditions deemed dangerous to public health or safety: or,
(b) These Flood Plain Development Regulations supplement all laws of the United States and State of Ohio relating to the purposes of this Chapter and shall not be construed to abrogate or impair the enforcement of any such law. In the event a requirement of this Chapter is found to be at variance with a Federal or State Statute. or with an Administrative Rule or Regulation promulgated under such Statute, the most restrictive standard shall govern.
(c) No provision of this Chapter shall be construed to repeal, abrogate, or impair the enforcement of any easement, covenant, deed restriction, subdivision regulation or other land use regulation arising from contract or otherwise recognized at law or in equity. In the event a requirement of this Chapter is found to be at variance with any such easement. covenant. deed
restriction, subdivision regulation or other land use regulation, the most restrictive standard shall govern.
(d) All provisions of this Chapter shall be liberally construed to effectuate the purposes of this Chapter as enumerated in Section 1333.04.
