1335.01 DEFINITIONS.
   As used in this chapter:
   (a)   "Basement" means a portion of a building located partly underground, but having less than two-thirds of its clear floor-to-ceiling height below the average grade of the adjoining ground.
   (b)    "Cellar" means a portion of a building located partly or wholly underground and having two-thirds or more of its clear floor-to-ceiling height below the average grade of the adjoining ground.
   (c)    "Dwelling" means any building or structure, industrialized unit, manufactured housing unit or part thereof that is used or intended to be used for living or sleeping.
   (d)    "Dwelling unit" means any room or group of rooms located within a dwelling and forming a single habitable unit with facilities which are used or intended to be used for living, sleeping and cooking.
   (e)    "First story" means the story of a dwelling at or next above the grade of the adjoining ground.
   (f)    "Habitable room" means a room or enclosed floor space used or intended to be used for living, sleeping, cooking or eating purposes, excluding bathrooms, water closet compartments, laundries, pantries, foyers or communicating corridors, closets and storage spaces.
   (g)    "Multiple dwelling" means any dwelling containing more than two dwelling units.
   (h)    "Occupant" means any person living, sleeping, cooking or eating in or having possession or use of a dwelling, dwelling unit or rooming unit.
   (i)   "Operator" means any legally responsible person who has charge, care or control of a dwelling or part thereof in which dwelling units or rooming units are leased or let.
   (j)    "Owner" means any legally responsible person who, alone or jointly or severally with others:
      (1)    Holds title of record to any dwelling, with or without actual possession thereof; or
      (2)    Has charge, care or control of any dwelling as agent of the owner, or as executor, executrix, administrator, administratrix, trustee or guardian of the estate of the owner.
   (k)    "Rooming house" means any dwelling or that part of any dwelling containing one or more rooming units, in which space is let for compensation by the owner or operator to five or more persons, none of whom are related to the owner or operator by blood or marriage, but not including a hotel licensed under Ohio R.C. Chapter 3731. Dwellings in which space is let to fewer than five persons shall not be deemed a rooming house.
   (l)   "Rooming unit" means any room or group of rooms in a rooming house or dwelling forming a single habitable unit used or intended for use for living or sleeping, but not for cooking, storing food or eating purposes.
   Whenever the words "dwelling", "dwelling unit", "rooming house", "rooming unit", "premises" "structure" are used in this chapter, they shall include the plural of these words and be so interpreted as if they were followed by the words "or any part thereof."
