(a) After the completion of a new building or structure, the erection of any industrialized unit or manufactured housing unit, or the alteration of any such building, structure, industrialized unit or manufactured housing unit, the owner thereof shall make written application to the Building and Zoning Commissioner for the issuance of a Certificate of Compliance attesting to the fact that all improvements so constructed or erected comply with all provisions of the Ohio Building Code, the Ohio Residential Code for One, Two and Three Family Dwellings, the Permanent Foundations Guide for Manufactured Housing and any other technical codes adopted by Ordinance applicable to the premises and the intended use thereof.
(b) Before changing the existing use of any parcel of land or structure, the owner thereof shall make written application to the Building and Zoning Commissioner for the issuance of a Certificate of Compliance attesting to the fact that the proposed use will comply with all provisions of the Ohio Building Code, the Ohio Residential Code for One, Two and Three Family Dwellings, the Permanent Foundations Guide for Manufactured Housing and any other technical codes adopted by Ordinance applicable to the premises and the intended use thereof.
(c) Within seven (7) days following receipt of an application for the issuance of a Certificate of Compliance required by subsection (a) or (b) hereof, the Commissioner shall inspect the premises and shall issue the requested Certificate unless the Commissioner finds that:
(1) The proposed use is not permitted on the premises by the Zoning Code; or
(2) The proposed use is not permitted on the premises as presently constructed or equipped by provisions of the Ohio Building Code, the Ohio Residential Code for One, Two and Three Family Dwellings, the Permanent Foundations Guide for Manufactured Housing or other technical code adopted by Ordinance applicable to structures devoted to the intended use.
In the event the Commissioner determines that a portion of a building, structure, industrialized unit or manufactured housing unit is in compliance with all applicable code requirements and suitable for the intended use, the Commissioner may issue a Certificate of Compliance as to that portion conditioned upon the installation of appropriate modifications to secure the code compliant portion of the structure from portions not suitable for immediate use or may issue a temporary Certificate of Compliance authorizing use of the building, structure, industrialized unit or manufactured housing unit conditioned on completion of designated improvements within a designated time.
(d) No person shall use or occupy any parcel of land without a Certificate of Compliance required by this section.
(e) The Commissioner shall keep a record of all Certificates of Compliance. He shall furnish a copy of any such certificate, or of the record attesting to the issuance thereof, without charge to any person having a proprietary or tenancy interest in the land or building affected and shall furnish copies to all others upon request and the payment of the charges for the reproduction of public records in effect on the date the request for a copy of such record is received.
