(a) The City Administrator shall establish a program to detect and eliminate illicit discharges and illegal connections to the MS4. The program required by this Section shall include: comprehensive mapping of the MS4 and periodic inspection of all outfalls to determine the quantity and composition of substances flowing to the MS4.
(b) In the event inspection of any outfall demonstrates the existence of an illicit discharge, the City Administrator and such municipal employees as are designated by the City Administrator to implement the program mandated by this Section are authorized to enter and inspect all premises located up-stream of the illicit discharge as often as may be necessary to verify compliance with this Chapter, determine the actual source or sources of the illicit discharge and identify all illegal connections through which prohibited substances flow to the outfall. The City Administrator may monitor the quantity of storm water discharged from any premises and draw samples of the effluent for analysis to detect the presence of substances other than storm water. In furtherance of this authority, the City Administrator may install, operate and maintain such temporary or permanent devices as are, in the City Administrator's opinion, reasonably necessary to conduct flow monitoring or water quality sampling of discharges emanating from the premises.
(c) In the event the City Administrator or a municipal employee designated by him to implement the program mandated by this Section is refused access to any premises reasonably believed to be a source of illicit discharge or to any premises scheduled for routine inspection as part of a comprehensive inspection and sampling program to verify compliance with this Chapter, the City Law Director is authorized to commence such proceedings as may be available under general law to obtain a criminal or administrative search warrant.
(d) No person shall unreasonably delay or prevent the City Administrator or his designee from entering premises pursuant to the authority of a search warrant.
(e) No person shall remove, tamper with the calibration of or otherwise interfere with the operation of any monitoring or sampling device installed pursuant to the authority of this Section.
