505.08 NUISANCE CONDITIONS PROHIBITED.
   (a)   No person shall keep or harbor any animal in the Municipality so as to create noxious or offensive odors or unsanitary conditions.
   (b)   No person exercising control over an animal shall permit it to scratch, dig or defecate on any public land, public right of way or private property that is not owned or occupied by the owner or keeper of such animal; provided, however, that any nuisance prohibited by this subsection shall be deemed abated if the owner, keeper or person in control of said animal immediately removes all feces deposited by such animal and disposes of such fecal matter in a sanitary manner.
   (c)   Whoever violates this section is guilty of a minor misdemeanor for a first offense and a misdemeanor of the fourth degree for each subsequent offense.
