373.12 LICENSING OF BICYCLES.
   (a)   License Required: Fee. No person shall ride or propel a bicycle on any street or other public way in the City, or upon any part thereof, unless the bicycle has been provided with a license issued by the Mayor as hereinafter provided. Licenses shall be effective for three calendar years and shall be renewable for a like period. The fee for each three-year period shall be three dollars ($3.00). However, after the expiration of the first year of the period, the fee shall be one dollar ($1.00) for the remainder of the period.
   (b)    Applications. An application for a license and license plate shall be made to the Chief of Police upon a form to be provided by him or her. The application shall be accompanied by the fee prescribed in subsection (a) hereof, which fee shall become the property of the City at the time of the issuance of the license. If the Chief of Police approves the application, he or she shall so indicate in writing thereon and deliver the same, together with the fee, to the Mayor. If he or she does not approve the application, he or she shall return the fee to the applicant. The Chief of Police, or any police officer designated by him or her, shall inspect each bicycle presented to him or her for licensing and may refuse to approve the application for a license for any bicycle found to be in an unsafe mechanical condition.
   (c)    Issuance and Renewal. The Mayor may issue the license and license plate upon approval of the application by the Chief of Police. Every license plate shall have displayed upon it the registration number of the bicycle licensed and the name of the City. The Mayor and the Chief of Police shall each keep a record of the issuance of licenses, which record shall indicate the name of the licensee, the license number and the number and make of the bicycle frame. The Mayor shall also keep a record of all fees collected for the issuance of licenses. A new license plate shall be issued upon renewal of the license. The purchase of a new plate shall be recorded on the license and on the duplicate at the time of purchase. Except when an application is rejected, no owner or operator of bicycle shall be entitled to a refund of any part of a license fee.
   (d)   Penalty. Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
