(a) No person shall park in a devil strip or tree lawn area without first obtaining a permit therefor from Council. Council will only authorize parking in such an area upon the recommendation of the Board of Control.
(b) In deciding to recommend the issuance of a permit for tree lawn parking, the Board of Control shall consult with the various administrative departments and safety forces to solicit possible objections to the permit. The Board shall review the application for a permit and make a recommendation to Council only if all of the following criteria are met:
(1) There is a bona fide hardship. As used in this section, "bona fide hardship" means a physical limitation, unique to the individual or particular property for which permission is requested.
(2) There is no parking lane at the curb on either side of the street.
(3) Permitting parking on the tree lawn will not obstruct vision at the intersection.
(4) Permitting parking on the tree lawn is the only realistic manner in which the hardship can be eliminated.
(c) Applications for a permit may be obtained from the Clerk of Council.

(d) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
