(a) The Executive Director of the Defiance County Community Improvement Corporation shall annually review the performance of each employer to whom a grant of Job Creation Incentive Program assistance has been awarded to determine the grantee’s entitlement to payment under the standards of Sections 191.10(a), (b) or (d) during the next following calendar year. The annual review shall be conducted during the month of September and the Executive Director shall report his or her findings to each grantee and to the Job Creation Incentive Program Committee on or before September 30.
(b) On or before October 15 of each year, the Job Creation Incentive Program Committee shall convene in public meeting to review the Executive Director’s findings with respect to grantees’ entitlement to receive payment during the next following year. Each grantee shall be afforded an opportunity to be heard regarding the grantee’s entitlement to payment. The Job Creation Incentive Program Committee shall adopt a resolution setting forth its findings as to the entitlement of each grantee to receive payment and the total appropriation required to fund the payments to become due in the next calendar year.
(c) The resolution adopted by the Job Creation Incentive Program Committee in accordance with subsection (b) hereof shall be promptly filed with the Finance Director and Clerk of Council of the City of Defiance for consideration in conjunction with the adoption of the annual budget for the next following year.
(d) The annual appropriations ordinance adopted for the next following year shall include an appropriation of funds for use by the Defiance County Community Improvement Corporation in an amount sufficient to pay all Job Creation Incentive Program assistance determined to be payable by the resolution of the Job Creation Incentive Program Committee. Council may employ funds drawn from any legally available source of revenue to support the appropriation.
(e) The Finance Director shall disburse all moneys appropriated in accordance with subsection (d) hereof to the Defiance County Community Improvement Corporation no later than June 30 of the calendar year for which the appropriation is made. No additional legislative action shall be required to authorize the expenditure.
(f) The Defiance County Community Improvement Corporation shall disburse all grants of Job Creation Incentive Program assistance to the recipients entitled thereto within fourteen days following receipt of the necessary funds from the Finance Director.
