(a) No person shall keep, harbor, own, or maintain upon any one property more than five (5) total adult dogs and/or cats, nor any combination of adult dogs and cats exceeding five (5).
(b) In the event that a household pet dog or cat gives birth, the young animals will not be considered in the above number limitation during the first 120-day period of their lives.
(c) This section shall not apply if the property owner where the dogs or cats are being kept, harbored, owned, or maintained holds a valid, current, kennel license issued by Hamilton County and kennels are a permitted use on that property.
(d) Whoever violates or fails to comply with any of the provisions of this section shall be guilty of an unclassified misdemeanor and shall be fined or incarcerated as follows:
(1) For the first conviction of an offender for violating this section, the offender shall be fined one hundred and fifty dollars ($150.00) per dog or cat in excess of five (5).
(2) For a second conviction of the same offender for violating this section within a period of two (2) years, the offender shall be fined not less than five hundred dollars ($500.00) per dog or cat in excess of five (5).
(3) For a third or any subsequent conviction of an offender for violating this section within a period of two (2) years, the offender to shall be fined not more than seven hundred and fifty dollars ($750.00) per dog or cat in excess of five (5).
