The following regulations shall apply to private sewerage systems:
(a) Where a public sanitary sewer is not available under the provisions of this chapter, the building sewer shall be connected to a private sewerage system complying with the regulations of the Hamilton County Board of Health and such other applicable provisions set forth by the City of Deer Park.
(b) Before commencement of construction of a private sewerage system, the owner shall first obtain a permit from the Hamilton County Board of Health and from the City of Deer Park Building Division. The owner, at the time of obtaining a permit for such construction, shall assure that the private sewerage system shall be constructed in compliance with all applicable laws, ordinances and regulations affecting such private sewerage systems and shall assure that such private sewerage system will be maintained in good operating and healthful conditions so as not to be offensive to neighboring properties.
(c) If the City and/or the Hamilton County Board of Health determines that a private sewer system requires maintenance or repairs, the City and/or Hamilton County Board of Health shall give written notice to the owner of such property to perform such maintenance or make such repairs by a date certain. If the owner does not comply with the terms of the written notice, the City may enter upon the premises and perform the necessary maintenance or repairs at the expense of the owner. The cost for such repairs and maintenance as performed at the direction of the City shall be promptly paid by such owner, person, or legal entity. The amount of money expended therefor shall be a valid claim against such owner, occupant or person in charge. Failure to reimburse the City for said expenses shall result in a lien placed upon such land, which may be enforced by suit in any court of competent jurisdiction, or the City may certify the total cost, with a proper description of the premises, to the Hamilton County Auditor, who shall place such costs upon the tax duplicate. The costs or lien upon such lands and after the date of entry shall be collected as other taxes and returned to the City of Deer Park.
(d) At such time as a public sewer becomes available to a property served by a private sewerage system, a direct connection shall be made to the public sewer within six (6) months of such availability in compliance with this chapter. Any septic tanks, cesspools, and similar private sewerage disposal facilities shall be abandoned and filled with stone or other suitable material within thirty (30) days after connection to the public sewer. The owner shall comply with all applicable requirements of law and/or any specific provisions promulgated by the Hamilton County Board of Health and/or City of Deer Park.
