(a) “Memorial” shall mean the City of Deer Park Veteran’s Memorial consisting of the perimeter within which are memorial improvements, structures, memorial plaza, markers, memorial accessories, memorial displays and the surrounding grounds, all of which have been dedicated in honor of veterans who served in the armed services of the United States of America, and which is located within Chamberlin Park, Deer Park, Ohio.
(b) No person shall mount, ascend, scale or otherwise deliberately place the weight of their person upon any of the Memorial walls, flagpoles, memorial structures, markers, statutes, displays or equipment, shrubbery, landscaping or upon any other vertically erected Memorial improvements not designed as steps, walkways or pedestrian areas.
(c) No person shall sit or utilize any chairs, stools, or other sitting apparatus within the Memorial, including the Memorial concrete steps. This subsection does not apply to any provided park bench or seating specially designated or provided by the City within the Memorial.
(d) No person shall operate any device or mechanism by which a person or property is transported or conveyed, including but not limited to a bicycle, skateboard, roller blades or roller skates. This subsection does not include any device or mechanism used for the purpose of assisting the mobility or transportation of disabled persons or infants.
(e) No person shall permit any animal within their ownership or control to be located within the Memorial.
(f) No person shall place any beverage or other consumable item upon any part of the Memorial or within the perimeter of the Memorial.
(g) No person shall consume any foodstuffs or possess any open foodstuffs within the Memorial.
(h) No person shall dispose of any garbage, refuse, or litter within the Memorial, except for the disposal of such items within any receptacle placed by the City within the Memorial for such purpose.
(i) Unless permitted in advance by the City, no person shall place any article or personal property or effects upon any part of the Memorial or within the perimeter of the Memorial.
(j) The City shall post and maintain signage within the vicinity of the Memorial referring to this Section and containing warnings giving reasonable notice of the prohibited conduct herein.
(k) Any person who is found to violate this section shall be guilty and punished as follows:
(1) Except as otherwise provided within this subsection, a minor misdemeanor;
(2) If within one year of the violation the offender has been previously found guilty of a violation of this section, a misdemeanor of the fourth degree; or
(3) If within one year of the violation the offender has been previously found guilty of two or more violations of this section, a misdemeanor of the third degree. (Ord. 99-38. Passed 12-13-99.)
