Service Provider shall indemnify, protect, defend, and hold the Municipality, its officers, employees, agents and representatives, harmless from any and all claims or causes of action for injury, damage, loss, liability costs or expense, including court costs and reasonable attorney fees or expenses arising from any casualty or accident to person or property by reason of any construction, excavation, operation, maintenance or any act or omission done under this agreement by or for Service Provider, its agents, or employees, or by reason of neglect or omission of Service Provider to keep its Telecommunications System in a safe condition. Service Provider shall consult and cooperate with the Municipality while conducting its defense of the Municipality. (Ord. 01-19. Passed 6-11-01.)
