913.06 COSTS.
   (a)   When it is deemed necessary to cut and destroy any tree, plant or shrubbery, or part thereof, or noxious weeds or rank vegetation, in accordance with the provisions in this chapter, the owner shall be charged at the rate of ninety-one dollars ($91.00) per person per hour or any portion thereof, or the actual cost of such work, whichever is larger. The minimum charge therefor shall be ninety-one dollars ($91.00).

   (b)   If it is necessary for the City to cut or remove any tree, plant, shrubbery, noxious weeds or rank vegetation at a given property for a second time within a 90 day period, there shall be a civil penalty of $250.00 assessed in addition to the actual costs of any work performed.
   (c)   If it is necessary for the City to cut or remove any tree, plant, shrubbery, noxious weeds, or rank vegetation at a given property for a third time within a 90 day period, there shall be a civil penalty of $500.00 assessed in addition to the actual costs of any work performed.
   (d)   The owner, or owners, shall be billed directly by priority mail with delivery confirmation, by certified mail, return receipt requested, or by posting a copy of the bill at the subject property. The costs shall be paid within thirty days after receipt of the bill.
   (e)   If the above costs are not paid, the Council Clerk shall certify the total costs, together with a property description of the lands, to the County Auditor, who shall place the costs upon the tax duplicate. The costs are a lien upon such lands from and after the date of entry. The costs shall be collected as other taxes and returned to the City.
