12.08.100: VIOLATIONS AND PENALTIES:
   A.   Because a failure to maintain the sidewalks free of hazardous conditions creates a public safety concern, failure to do so by any property owner shall be an immediate violation of this chapter. Upon direction of the City Maintenance Department or another City designee, the City may demand by certified mail, personal delivery, or posting on the premises, any property owner or occupant to immediately remove snow and ice, filth, or other obstructions or encumbrances from the sidewalk as provided by this chapter to cure the violation; however, notice by the City is not required before a citation may be served. The City Attorney may be notified and may cause legal action to be taken against the property owner or occupant who violated any provisions of this chapter.
   B.   It is unlawful for any person to walk upon any freshly laid concrete sidewalk on any public street or avenue; or for any person owning or harboring any dog or other animal to permit such dog or animal to run at large on any public street or avenue in the vicinity of freshly laid concrete sidewalks; or for any person to damage, deface or destroy any portion of any sidewalk by any means whatsoever.
Violators of this section shall be guilty of an infraction for the first offense with a fine of one hundred dollars ($100.00); and in the case of multiple offenses within a twelve (12) month period, the violator shall be guilty of a misdemeanor, punishable pursuant to this Code and the Idaho Code.
