§ 70.01 SPEED LIMITS ON COUNTY ROADS.
   (A)   No person shall drive a vehicle on a county highway at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing. In every event speed shall be so restricted as may be necessary to avoid colliding with any person, or vehicle or their conveyance on or near, or entering a county highway in compliance with legal requirements and with the duty of all persons to use due care.
   (B)   Except when a special hazard exists that requires lower speed for compliance with division (A) of this section, the limit specified in this section or established as hereinafter authorized shall be maximum lawful speed, and no person shall drive a vehicle on a county highway at a speed in excess of such maximum limits:
      (1)   Forty miles per hour on any hard surface county highway. (Hard surface being any concrete, asphalt or other form thereof.)
      (2)   Thirty miles per hour on any gravel, dirt, or other aggregate material highway.
      (3)   Twenty miles per hour on any unincorporated subdivision roadway accepted for maintenance by the Board of Commissioners.
      (4)   Twenty-five miles per hour in any established school zone with children present.
      (5)   The maximum speed limits set forth in this section may be altered as authorized in division (D) below of this section.
   (C)   The driver of every vehicle shall, consistent with the requirements in division (A), drive at an appropriate reduced speed when approaching and crossing an intersection or railway grade crossing, when approaching and going around a curve, when approaching a hill crest, when traveling upon any narrow or winding roadway, and when special hazard exists with respect to pedestrians or other traffic or by reason of weather or highway conditions.
   (D)   Whenever the Board of Commissioners determines that any maximum speed hereinbefore set forth is greater or less that is reasonable or safe under the conditions found to exist at any intersection or other place or on any part of the county highway system, said commissioners may determine and declare a reasonable and safe maximum limit thereon, which shall be effective when appropriate signs giving notice thereof are erected. Such maximum speed limits may be declared to be effective at all times or at such times as are indicated on said signs.
