§ 50.56 REQUIREMENTS FOR APPLICATION, MARKETING AND DISTRIBUTION WITHIN THE COUNTY.
   Any biosolid waste product produced or generated in the county shall only be applied, marketed and/or distributed by a person as defined in I.C. 13-11-2-158(a) to any land within the county if the following occur:
   (A)   Such person shall have a valid permit for land application, marketing, and/or distribution of biosolid waste product as required in 327 IAC 6.1 et seq., and such person shall be in compliance with all state laws, rules and regulations applying thereto;
   (B)   Such person obtains a permit from the County Board of Health or its designee, for land application, marketing, and/or distribution of biosolid waste product, pursuant to the rules and regulations adopted by the County Board of Commissioners, prior to any application, marketing and/or distribution of biosolid waste product; and
   (C)   Such person shall apply to renew such permit with the county annually upon the date of such permit's issuance.
