§ 150.01 ADOPTION OF STATE BUILDING CODE; STANDARDS OF SAFETY.
   (A)   The Kentucky Building Code, as contained in 815 KAR 7; the Kentucky Plumbing Code, as contained in 815 KAR 20; the Kentucky Standards of Safety, as contained in 815 KAR 10; together with any amendments, are hereby adopted by reference as if fully set forth in this code of ordinances.
   (B)   Copies of the above codes and any amendments thereto shall be placed on file in the office of the City Clerk/Treasurer where they shall be available for public inspection during normal business hours.

§ 150.02 ENFORCEMENT.
   (A)   The city shall employ or contract with a Building Official who shall have responsibility for the enforcement of the State Building Code.
   (B)   The Fire Chief, along with all other officers, agents and employees of the city, are hereby charged with the enforcement of the provisions of the Standards of Safety.

§ 150.03 BOARD OF APPEALS.
   (A)   Pursuant to KRS 198B.070, there is hereby established in the city a board to be called the Board of Appeals, consisting of five technically qualified persons with professional experience related to the building industry to hear appeals from the decision of the local Building Official in accordance with the requirements of KRS 198B.070.
   (B)   The members of the Board shall be appointed by the Mayor with the approval of the City Council. At least three members of the Board must not be employed by the city or its agencies. The Mayor shall designate one of the members to serve as Chairperson.

§ 150.04 BUILDING PERMITS; FEES AND INSPECTIONS.
   (A)   Permit required. It shall be unlawful to construct, alter, remove or demolish or to commence the construction, alteration, removal or demolition of a building or structure or install equipment for the operation of a building or structure without first filing with the Building Official an application in writing and obtaining a formal permit.
   (B)   Permit costs.
      (1)   The permit fee shall be based on the following scale:

      (2)   The City Clerk/Treasurer may take the fee and process the application, but only the Building Official shall issue the permit.
      (3)   The fee for razing a residential structure will be $10; the fee for commercial structures will be $50. In addition, the fee for moving a structure will be $15, with the exception that no substandard structure will be moved from one location to another.
   (C)   Permit inspections. The Building Official will perform a minimum of three inspections upon notification by the permit applicant. If the applicant does not give notice to the Building Official, the Official may require the applicant to provide sufficient evidence that the work was properly done.
 
First inspection
While footings are being laid.
Second inspection
When structural frame is complete and wiring is in place; wiring exposed and junction boxes are exposed.
Third inspection
Upon completion of structure.
 
   (D)   Occupancy. The structure may be occupied upon receipt of a certificate of occupancy from the Building Official.

§ 150.05 PLUMBING PERMITS.
   (A)   As used in this section, PLUMBING means the art of installing in buildings the pipes for distributing the water supply, the fixtures for using water and drainage pipes for removing waste and sewage, together with fittings, appurtenances and appliances of various kinds, all within or adjacent to the building. It shall include:
      (1)   The water service pipe which forms the connection between the property line and the building;
      (2)   Private water supply systems;
      (3)   House sewers which convey the wastewater and sewage from the building to the property line or other points of disposal; and
      (4)   Storm sewers, rain water piping and private sewage disposal systems.
   (B)   No person shall construct, install or alter any plumbing, sewerage or drainage system within the city without first having procured a plumbing installation permit from the County Health Department; provided, however, that, no permit shall be required for the repair of leaks, cocks, valves or for cleaning out waste or sewer pipes. All plumbing shall comply with the State Plumbing Code.

§ 150.99 PENALTY.
   (A)   The imposition of the penalties herein prescribed shall not preclude the city from instituting an appropriate action or proceeding to prevent an unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use, or to restrain, correct or abate a violation, or to prevent the occupancy of a building, structure or premises, or to prevent an illegal act, conduct, business or use in or about any premises.

   (B)   Any person who violates any provision of the state codes adopted in § 150.01 shall be subject to the following penalties.
      (1)   Violators of the State Building Code or 815 KAR 7:125 shall, upon conviction, be subject to a fine of not less than $10, nor more than $1,000, for each offense.

      (2)   Violators of the State Standards of Safety shall, upon conviction, be subject to a fine of not less than $25, nor more than $1,000, imprisonment for not more than 60 days, or both, for each offense.

      (3)   Violators of the State Plumbing Code shall, upon conviction, be subject to a fine of not less than $10, nor more than $100, imprisonment for not more than 90 days, or both, for each offense.
