A. Investigation; Hearing: The city manager or his or her designated representatives shall investigate all facts set out in the application. A public hearing shall be held before the city council prior to any action taken on the license application.
B. City Council Action; Criteria For Evaluation: After such investigation and hearing, the city council shall grant or refuse the application. Criteria for evaluating a license shall include the following:
1. Application shall be completed in full.
2. Applicant shall be eligible for license.
3. Location shall be eligible for license.
4. Applicant shall provide description of merchandise, services or entertainment for sale in premises.
5. Applicant shall identify means of restricting access by minors and shall not employ any minors.
6. Applicant shall provide property owner's name and address and business owner's name and address.
7. The adult use shall be in compliance with all applicable city code regulations
C. Transferability: Each license shall be issued to the applicant only and shall not be transferable to another holder. Each license shall be issued only for the premises described in the application. No license shall be transferred to another place without the approval of the city council. (Ord. 227, 5-6-1997)
