A. Power To Grant: Where the planning commission finds that extraordinary circumstances may result from strict compliance with these regulations, it may vary the regulations so that substantial justice may be done and the public interest secured; provided, that such variation will not have the effect of nullifying the intent and purpose of the general community plan or these regulations.
1. Small Subdivisions: In particular, small subdivisions, where one lot is divided into two (2) or three (3) lots, the submission of topographic maps, soil tests, other data and fee may not be necessary if the city council after consultation with the planning commission, so determines.
2. Minor Subdivision Of Larger Areas: Minor subdivision of larger areas, where a tract of land over five (5) acres is divided into two (2) parcels, shall be exempted from all the provisions of this chapter. However, a dimensioned map of such subdivision shall be filed with the city clerk within thirty (30) days after the subdivision has been made.
B. Conditions: In granting variances, the planning commission may require such conditions as will, in its judgment, secure substantially the objectives of the standards or requirements so varied or modified. (Ord. 217, 3-2-1992)
