10-3-14: MANUFACTURED HOMES AND MOBILE HOMES REQUIREMENTS:
A manufactured home is considered a mobile home under this section and is a structure, transportable in one or more sections, which in the traveling mode, is eight feet (8') or more in width or forty (40) body feet or more in length, or when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with plumbing, heating and air conditioning and electrical systems contained therein, and which meets all the requirements established under Minnesota statutes section 327.31, the manufactured home building code, as it may be amended from time to time. Only manufactured homes which comply with the manufactured home building code established by Minnesota statutes section 327.31, as it may be amended from time to time, may be located in and used as a dwelling within the city. A mobile home, manufactured home, house trailer or other mobile dwelling which does not comply with the manufactured home building code and which is used as a residence after the date of the adoption of this code is a nonconforming use as defined by Minnesota statutes section 462.357, subdivision 1e, as it may be amended from time to time, and this nonconforming use may be continued, including through repair, maintenance, replacement, restoration or improvement but if the nonconformity or occupancy is discontinued for a period of more than one year, or the nonconforming use is destroyed by fire or other peril to the extent of greater than fifty percent (50%) of its market value and no building permit is applied for within one hundred eighty (180) days of when the property is damaged, any subsequent use or occupancy of the land or premises shall be a conforming use or occupancy.
